Terms of Use

Please read these Terms before using Artfull AI. Artfull AI is currently a development build and is not available on the App Store. These Terms apply to the website and to any authorised test or future public version of the app. They supplement any terms supplied by Apple and do not remove rights that the law gives you.

1. About these Terms

Artfull AI (“the App”) is developed by Joe Woods (“we”, “us” or “our”). By using the App or this website, you agree to these Terms. If you do not agree, do not use them.

If you obtain the App through Apple’s App Store, Apple’s Standard Licensed Application End User License Agreement also applies unless a valid custom licence is presented through the App Store. These Terms supplement that agreement. They do not alter Apple’s obligations or conflict with Apple’s applicable terms; if there is an unavoidable conflict, the Apple terms control to the extent required for App Store distribution.

2. Licence and permitted use

Subject to these Terms and Apple’s applicable usage rules, we grant you a personal, limited, non-exclusive, non-transferable and revocable licence to use the App on Apple devices that you own or control. The App is licensed, not sold.

You must not copy, redistribute, sell, sublicense, reverse engineer, defeat security controls or create derivative works from the App except where applicable law or an open-source licence expressly permits it.

3. AI services that you choose

Artfull AI is a client application and does not include an AI service, provider account or usage allowance. You choose and configure compatible services, which may include Ollama, LM Studio, Apple Intelligence, On-device MLX models, Ollama Cloud, OpenRouter, OpenClaw or a Custom LLM Router.

We do not control a third-party service and are not responsible for its acts, omissions, content, retention practices, charges or availability. Nothing in this paragraph limits responsibility that cannot lawfully be excluded.

4. Your content and documents

You retain your rights in prompts, documents, images and other material you provide. You give the App permission to process that material only as needed to perform the action you request, including extracting supported content and sending it to the connection you selected.

You must have the necessary rights and authority to use and transmit that material. Do not use the App to infringe intellectual-property, privacy or confidentiality rights, or to process content unlawfully. Keep independent copies of important material; the App is not a backup service.

5. AI output and responsible use

AI-generated output may be inaccurate, incomplete, biased or unsuitable. Review output before relying on it. The App is not a substitute for qualified professional advice, and you must not rely on it alone for medical, legal, financial, safety-critical or other high-impact decisions.

You must not use the App to break the law, harm others, gain unauthorised access, distribute malicious software, or interfere with the App, a provider or another system.

6. Basic and Advanced access

The current development build does not enforce purchases and the price of Advanced has not been set. If Advanced is offered publicly, it is planned as a one-time in-app purchase rather than an automatically renewing subscription unless the purchase screen clearly states otherwise before you buy.

App Store purchases are processed by Apple under the terms and price shown at confirmation. Apple ordinarily handles billing and refund requests through its services. This does not reduce any remedy or statutory right you may have against us under applicable law.

7. Privacy and security

Our Privacy notice explains how the App processes prompts, attachments, connection details, histories, credentials and response statistics. Choose only destinations you understand and trust. No software or network is completely secure, and availability can be affected by your device, network, server or provider.

8. Ownership

Except for third-party components and material belonging to users or providers, Artfull AI’s name, design, code and website content are owned by Joe Woods and protected by applicable intellectual-property law. Third-party and open-source components remain subject to their respective licences.

9. Availability, updates and termination

We may fix, update, change or discontinue features, provider integrations or development access. Compatibility can change when Apple, model authors or external providers update their systems. Where reasonably possible, material changes will be explained.

Your licence ends if you materially breach these Terms. Provisions that by their nature should continue—including ownership, liability and governing-law provisions—remain effective after termination.

10. Warranties and liability

Nothing in these Terms excludes or restricts liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, breach of your statutory consumer rights, or any other liability that cannot lawfully be excluded or restricted.

Subject to that protection, the App and website are provided on an “as available” basis. We do not promise uninterrupted operation, compatibility with every device, model or server, or the accuracy of AI output. We are not responsible for losses that were not reasonably foreseeable when these Terms were agreed, or for business losses suffered by a person using the App wholly or mainly for business purposes.

11. Consumer rights

Nothing in these Terms excludes or restricts your statutory rights as a consumer. In particular, these Terms do not exclude the rights and remedies for digital content that cannot be excluded under the Consumer Rights Act 2015. If mandatory consumer law in your country gives you additional protection, that protection continues to apply.

12. Changes to these Terms

We may update these Terms when the App, its services or applicable law changes. The date at the top will show the latest revision. We will provide reasonable notice of a material change where required by law. Changes do not retrospectively remove rights that have already arisen.

13. Governing law and courts

These Terms are governed by the laws of England and Wales, subject to any mandatory consumer protections that apply to you. The courts of England and Wales will have non-exclusive jurisdiction. If you live in another part of the United Kingdom, you may also bring proceedings in the courts where you live. Consumers elsewhere retain any mandatory right to bring proceedings in their home courts.
